   Subject: Request for Order to Chief Minister Sindh and
   Minister of Education Sindh for offering orders of
   IBA test to All or Max: 50%, while rejecting 60% System.
   R/Sir,
   With due respects, I beg to state that with reference to advertisement in daily kawish in 14 and 15july 2008 that the department of Education is offering orders of IBA pass candidates above 60%. Daily kawish in 23 July 2008 that the Department of Education is offering orders of IBA pass candidates above 60%, while rejecting by all other candidates through World Bank Order And World Bank Has Offered Fund that Offer orders above 60% only.(By: Worthy Pir Mazahar -ul-Haq,Minister Of Education) .The test conducted by the IBA Sukkur that is Competent in sindh and also Candidates have given the priority to IBA test, all candidates were ready for that test and their opinion was that they will pass through Merit. The Institution has spent his time, money of the Govt and also took test tough, serious, well managed, and with disclipline.The passing percentage (rule) of the IBA was the 40% which is right/normal according to PST Teacher. The Forms were Filled Approximately two Lacs, all the students were appeared in the test and 25000 candidates have qualified their test but Govt is offering orders above 60% & on 60% on this behalf the Govt will select only 7200 teachers which is not equal to half of the passing students but just ¼ ratio of selection, then what’s advantage of test conducted by IBA, really all candidates appreciate to IBA institute that the institute has selected 40% marks for passing according to level of PST teacher. So it is Injustice with candidates to offer above 60%, because some were poorest, some have sold their goods from their home for filling forms and traveling etc.
   Education Department will took test for second time for 14000 blank seats so it is best to offer all those at this time why test conducted second time? So it is too difficult and due to huge Dearness in the country a poor can’t bear form fee, Document photocopies, courier service Again and Again etc.
   So please it is requested that in the name of Allah the Govt: Should follow the rules of IBA and should offer orders to all those candidates who have cleared test and reject the system of 60%.
   I also mention some Important points that:
   1. At university level a candidate is also eligible at 30 marks in entry
   Test that test is also conducted by these kind of same institutions like IBA.
   2. This is just PST teacher test and not commission test so 50% is Well.
   3. And I guarantee you that at present the Teachers are working as teacher (present in service) may not qualify the same test which was conducted by IBA now, its guarantee 10% teachers (present in service) can qualify the same test.
   4. Sindh Govt is offering orders at 60% so I assure you that many of candidates are working in Govt service are also included in that and they will leave the seat that seat will be empty as another candidate can came at that place it will be easy for Govt and also a advantage for candidate. So it is requested that Govt should follow IBA rule and Govt should reject 60% system and should offer to all or who has obtained 50%.
   5. The govt of sindh has offered the orders to the candidates Which belongs to Urban area and appointed in those schools in which three or four teachers are working it means govt has neglected to Rural areas and don’t wants to open the schools where the school is required and its clear Govt has neglected Rural areas and for that reason Pakistan education has been destroyed b/c all rural schools are closed still.

   I, therefore, requested you kindly In the Name Of Allah offer orders to all those candidates who have qualified their IBA test according to rules of IBA(40%),or who have got maximum 50% marks and reject the 60% system and don’t discourage the candidates as fully merit can be created. It will bless upon you and do well for candidates at human ground level.

   SUBJECT: PROVIDE LEGAL AID TO INDIGENT APPLICANT.

   Respected Sir,
   Applicant entreaty to decide matter urgently:

   BRIEF BIO-DATA OF APPLICANT:

   That I Nazir Ali S/o Sher Ali Shaikh Retired Telephone Operator in PTCL BPS-11 Department bearing EPI # 207600114, CNIC # 43304-2562984-1 R/o H.No:12/705 Khan Muhammad Street Shaikh Muhallah Shikarpur Sindh contact # 0726-521789. That I am serving my duties in Department from 1976 to retirement, my period of service passed well with un-blemished reputation and respect and my ACR is excellent and I had been awarded and appreciated by higher competent officers and neither any proceeding is pending against me nor ever been found guilty of professional or other misconduct and nor any suspension or other action ever be taken against me during my service tenure.

   NATURE OF MY CASE:

   1- That an Appeal submitted to PTCL authority of Subject: “Correction of date of birth and qualifying length of regular service for pension from date of Appointment on Equivalent base” in the reference of cases of Wafaqi Mohtasib’s findings in Lahore Case No. H/008198/06 dt: 13-06-2007 and complaint No. K/1194/2005 dt: 21-04-2005 Mr. M.Sami V/S PTCL, the PTCL filed Representation petition against complainant Mr. M.Sami to president of Pakistan and the Representation Petition of PTCL was rejected by President of Pakistan. Both the petitions are related to the counting of qualifying length of regular service for pension from date of appointment, both the petitions have been heard and decided in the favor of both PTCL retired employees accordingly and they avail the benefits. (MY MATTER IS ALSO SAME ANALOGOUS TO THEM).

   2- That my matter has not decided by PTCL authority after that I submit the request before of President and Prime Minister of Pakistan on the equality base. After that President Secretariat give instruction to CEO PTCL that “take an appropriate action as per rule and provide justice and redress his grievances” vide Control No. 15254/2008/P-II signed by Mr. Abdul Hameed Section Officer P-II and also P.M Secretariat vide letter No.P.M’s.sectt.U.o.No.F.1(11)/Misc/GR-III/08 on 21-06-2008 signed by Mr. Farroq Sultan section officer GR-III but PTCL authority neglected the instructions given to them and have not shown any fruitful result, after that I submit petition against PTCL to Wafaqi Mohtasib Lahore vide case No. HQR/0007006/08 dt: 14-07-2008 with reference to same finding as mentioned above in paragraph # 1. (Nature of my Case).

   3- That the Wafaqi Mohtasib Islamabad has not entertained, not allow for proceeding on the ground that “The issue raised by you is purely a Service matter and related to personal Grievances which are beyond the jurisdiction of Wafaqi Mohtasib”.

   4- That my Case No. HQR/0007006/08 dt: 14-07-2008 has not entertained and not allowed for proceeding for that I prefer an Appeal / Representation against the order / Letter to honorable President of Pakistan under Article – 32 of P.O’s No. 1 of 1983 on 12-09-2008 and my representation have been forwarded to Secretary Law and justice division Government of Pakistan vide letter No.8(01)/2008-Legal dated: 15-Sep-2008 Signed by Mr. Raja Qamar Sultan Section Officer Legal, which is pending for decision.
   May it please your honor Sir!
   That the above mentioned issues/ litigation rose in my plea are absolutely genuine and it is a retired service matter which have been created for me after retirement malafide intentionally which causes adversely and effected my health, happiness and me and my family members suffer from mental agony.
   My humble submission is that in such application to provide legal aid to indigent Applicant for giving efficacious remedy to me according to the rule of consistency and on the equality/ equivalent, same analogue and humanity base.

   I pray that your honor may be pleased to give me any relief which will be deemed fit in proper manner and you have to exercise your reserved powers for redressal of my grievances from concerned authority as per rule.
